Terms of Service
These Terms of Service ("Terms") are an agreement between you and Katchers Inc ("Sable", "we", "us"). They apply to the Sable website at sable.nyyx.ai, the Sable apps, and everything you can do in them (together, the "Service"). Please read them carefully. They include an agreement to resolve disputes by individual arbitration, described in section 17.
You accept these Terms when you tick the agreement box on your first visit, when you continue past the agreement shown under the sign-in buttons, when you agree in the "Agree to continue" prompt, or when you otherwise use the Service. If you do not agree, do not use the Service.
Our Privacy Policy explains what we collect and how we use it. It is part of how the Service works, and you should read it too.
1. Who can use Sable
Sable is for adults only. To use the Service you must be at least 18 years old and an adult under the law where you live. If either is not true, you must not use Sable.
When you first open Sable in a browser, we ask you to confirm this. If you tell us you are under 18, Sable closes in that browser and remembers that answer. Before you start a conversation, we ask your account to confirm it as well.
You must not use Sable if we have previously closed your account for breaking these Terms, or if using it would break a law that applies to you.
2. Your account
Browsing and reading are open without an account. Chatting with characters, publishing, commenting, buying coins and most other features need one.
You sign in with a Google or Apple account. We do not create or store a Sable password. You are responsible for keeping your Google or Apple account secure and for what happens under your Sable account. Tell us through Help if you think someone else has used it.
Each account is for one person. You must not share, sell or transfer your account, or create accounts to get around a suspension or to collect rewards more than once.
3. Adult content and age assurance
Sable contains characters and stories written for adults, and some include sexual content. Works are rated by their creators and reviewed by us, and those rated for adults are treated differently from the rest.
Access to works rated for adults may depend on how you have shown that you are an adult. Depending on the product settings in effect, your region and the law that applies to you, that may be your own confirmation that you are 18 or older ("self-declaration"), or age verification completed with our verification provider, Persona, using a photo of a government-issued ID and a selfie. We may change which kind of assurance is needed, and when, at any time. If you do not complete a required step, or verification is not successful, you may not be able to see or chat with those works. You can try verification again.
Persona collects and processes the ID and selfie images. Sable does not receive them. The Privacy Policy explains what we do receive.
You must not misstate your age, use someone else's identity or documents, or try to get around any age check.
4. How the Service works
Sable lets you read and chat with characters and stories, most of which are created by other users. Conversations are generated by artificial intelligence models provided by third parties, based on the character, the story, your persona and what you write. Some features, such as memory, suggested replies, scene images and videos, and Voice Talk calls, also use AI.
We keep improving Sable, so features, AI models, limits and prices may change, and some features may be offered only to some users, in some places, or for a limited time. We may also stop offering a feature.
5. AI conversations are fiction
Characters on Sable are AI. They are not real people, and nothing a character says comes from a real person or reflects our views. Treat everything in a conversation as fiction.
AI output can be inaccurate, inconsistent, offensive or unexpected, and it may resemble content that belongs to someone else. Do not rely on it for anything that matters. Sable does not provide medical, mental health, legal, financial or other professional advice, and a character is not a substitute for a professional.
If you are in crisis or thinking about harming yourself or others, stop using Sable and contact your local emergency services or a crisis line. In the United States you can call or text 988.
6. Coins
Coins let you use paid features, such as sending messages to characters, rewriting replies, choosing some AI models, adding personas and creating scene images or videos. The number of coins an action costs is shown in the app and may change. Coins are only deducted when a reply is delivered. If a reply fails, you are not charged for it.
What coins are. Coins are a limited, personal, non-transferable license to use features of the Service. They are not money, have no cash value, are not your property, and cannot be exchanged for money, transferred to another account, sold or given away, except where the law requires otherwise.
How you get coins. You can buy coin packs, and we may give you free coins, for example when you first sign up, as a regular refill, for a daily check-in, for inviting friends, or as part of a promotion. We decide whether and how free coins are offered, and we may change or end those offers.
Expiry. Coins you buy expire five years after the date of purchase. Free coins expire much sooner, and the period that applies is shown where the coins are offered: at the time of writing, welcome coins expire after 7 days, refill and daily check-in coins at the end of the following day, and coins from invitations and other reward programs after the period stated for that program. Expiry happens at the end of the stated day in Coordinated Universal Time (UTC). When you spend coins, the ones that expire soonest are used first. Expired coins cannot be restored.
Buying coins. Purchases are processed by Stripe or PayPal, and their terms also apply to your payment. Prices are shown before you pay and may include or exclude taxes depending on where you are. You must be authorized to use the payment method you choose.
Refunds. You can ask for a full refund of a coin pack within 14 days of buying it if none of that pack's coins have been used. Ask through Help and include the date of purchase. Otherwise, purchases are final, except where the law gives you a right to a refund. When we refund a purchase, the coins from it are removed from your balance.
Payment disputes. If you dispute a payment with your bank or payment provider, we may remove the related coins and may suspend your account while the dispute is open.
Closing your account. Any coins left in your account when it is closed are lost and are not refunded.
7. Invitations and rewards
We may run programs that reward you for inviting friends or for other activity. Each program has its own conditions, shown in the app, which also form part of these Terms. In general, rewards are given only for real, new users who complete the steps described, and not for your own additional accounts. We may withhold rewards, or refuse to give them, when we believe a program has been abused, and we may change or end a program at any time.
8. Your content
"Your content" means anything you create, upload or submit on Sable, including characters, stories, images, personas, comments, messages you send in conversations, and reports and support messages.
You keep ownership. You own your content, to the extent you had rights in it to begin with.
The license you give us. So that we can run the Service, you give us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt, translate, display, perform and distribute your content, and to use it to generate AI responses, for the purpose of operating, providing, promoting and improving Sable. For content you publish, this license lasts while it remains on Sable and for as long as we reasonably keep copies after it is removed, as described in the Privacy Policy. For private content, such as your conversations and personas, we use it only to provide the Service to you and as the Privacy Policy describes.
Published works. When you publish a character or story, other users can read it and chat with it. Works are reviewed, including for their age rating, before they become public, and edits are reviewed before they replace the public version. We may decline to publish a work, change its age rating, make it private, or remove it. When we decline a work or take it down, we tell you and give a reason. If you delete a work, it is removed from browsing and new conversations can no longer start, but people who already have a conversation with it may keep that conversation.
Conversation output. We do not claim ownership of the replies generated in your conversations. Because AI can produce similar output for different people, you may not have exclusive rights in it.
Your promises. You are responsible for your content. You confirm that you have all the rights needed to post it and to give us the license above, and that it follows these Terms.
Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.
9. Content rules
These rules apply to everything on Sable: published works, characters, images, comments, personas and the conversations you direct.
Minors. Every character must be an adult, 18 or older, and must not be presented, described or portrayed as a child or as childlike in a sexual context. Any content that sexualizes minors is strictly forbidden. We remove it, close the accounts involved, and report it to the appropriate authorities where the law requires or allows.
Real people. Do not create characters or content that depict or impersonate a real, identifiable person without their permission, and never create sexual content about a real person.
Consent. Do not create content that depicts, promotes or glorifies non-consensual sexual acts or sexual violence.
Also not allowed: content that is illegal where you or the audience are; content that encourages suicide, self-harm or eating disorders; credible threats, harassment, bullying, or sharing someone's personal information; hate speech or content that attacks people for who they are; content promoting terrorism or violent extremism; sale or promotion of illegal or regulated goods; spam, scams, and misleading or deceptive content; malware or links to it; and content that infringes someone else's intellectual property, privacy or publicity rights.
Adult sexual content between fictional adult characters is permitted only in works rated for adults, and only within these rules.
10. Conduct rules
You must not:
- use Sable in a way that breaks the law or harms others
- try to access other users' accounts, conversations or data, or use prompts to try to extract them
- scrape, crawl or collect data from the Service by automated means, or access it through bots, except as we expressly allow
- copy, reverse engineer or try to extract our source code, models, prompts or system instructions, except where the law allows
- interfere with, overload, probe or bypass the security, rate limits, age checks or other protections of the Service
- create or use multiple accounts to evade a suspension or to collect rewards or free coins more than once
- buy, sell or trade accounts or coins, or offer anything outside Sable in exchange for them
- use Sable to build or train a competing product or AI model
- impersonate Sable, our staff, or anyone else
11. Reporting, moderation and enforcement
You can report works and comments in the app, and block authors and conversations. We review reports and may act on them. Some protective steps are automatic: for example, a work reported as involving a minor is hidden immediately until someone reviews it, and a comment reported by several people may be hidden automatically.
We may review content and conversations to enforce these Terms, to keep people safe, to respond to reports and support requests, and to meet legal obligations, as described in the Privacy Policy. We are not obliged to monitor the Service, and we are not responsible for content created by users.
If you break these Terms, or we reasonably believe you have, we may remove or restrict content, limit features, and suspend or close your account, with or without notice. A suspended account can still contact us through Help and close itself. If you think we made a mistake, tell us through Help and a person will review your message.
12. Copyright complaints
We respect intellectual property rights. If you believe content on Sable infringes your copyright, send a notice to our designated agent — Katchers Inc, 16192 Coastal Highway, Lewes, Delaware 19958-3608, United States, [email protected] — that includes: your physical or electronic signature; a description of the copyrighted work; where the material you believe infringes is located on Sable; your contact information; a statement that you have a good-faith belief that the use is not authorized by the owner, its agent or the law; and a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner.
If your content was removed because of a notice and you believe that was a mistake, you may send a counter-notice to the same agent with the information the law requires. We may restore the content if the person who sent the notice does not start legal action within the time the law allows. We close the accounts of repeat infringers in appropriate circumstances.
13. Closing your account
You can close your account at any time in Settings. Closing starts a 7-day window in which you can cancel. After it ends, your account is closed, and your information is handled as described in the Privacy Policy. Works you published are made private rather than deleted, and coins left in your account are lost.
We may suspend or close your account, or stop providing the Service or part of it, at any time, including if you break these Terms, if we are required to by law, or if we stop offering Sable. Sections 6 (on what coins are and on refunds), 8, 12 and 14 through 19 continue to apply after your account is closed.
14. Changes to these Terms
Every version of these Terms has a version name. If we change what these Terms say about your rights or obligations, or other terms that matter to how you use Sable, we publish a new version and ask you to agree to it before you continue using features that need your agreement, such as chatting. If you do not agree, stop using Sable; you can still close your account.
We may correct typos and improve wording without changing anyone's rights or obligations. Those corrections update the current version without a new version and without asking you again.
The current version is always at sable.nyyx.ai/terms, and every earlier version stays available at sable.nyyx.ai/terms/ followed by its version name.
15. Disclaimers
The Service, including all content and AI output, is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Service will be uninterrupted, secure, error-free, or that content or AI output will be accurate, complete or appropriate.
Some places do not allow some of these disclaimers, so they may not all apply to you. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
16. Limitation of liability
To the fullest extent permitted by law, Sable and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or use, arising out of or relating to the Service or these Terms, even if we were told they were possible.
To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or US$100.
These limits do not apply to liability that cannot be limited under applicable law, such as liability for death or personal injury caused by negligence, or for fraud.
You agree to defend, indemnify and hold harmless Sable and its affiliates, officers, employees and agents from claims, losses and expenses, including reasonable legal fees, arising out of your content, your use of the Service, or your breach of these Terms, to the extent permitted by law.
17. Disputes and arbitration
Please read this section carefully. It affects how disputes are resolved.
Talk to us first. Before starting a formal proceeding, send a written notice describing the dispute and the relief you want to [email protected]. We will send ours to the contact information we have for your account. Both of us will try in good faith to resolve the dispute for 60 days.
Individual arbitration. If we cannot resolve it, you and Sable agree that any dispute arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration administered by JAMS under its consumer rules then in effect, rather than in court. The Federal Arbitration Act governs this section. The arbitrator may award the same individual relief a court could. Hearings may take place by video or in the county where you live.
Class action waiver. You and Sable may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not consolidate claims of more than one person.
Exceptions. Either of us may bring an individual claim in small claims court if it qualifies, and either of us may ask a court to stop the infringement or misuse of intellectual property.
Opting out. You can opt out of this arbitration agreement by emailing [email protected] from the email address of your Google or Apple account, with your Sable handle and a clear statement that you opt out, within 30 days after you first accept these Terms. Opting out does not affect any other part of these Terms.
If this section does not apply. If you opt out, if a claim is not subject to arbitration, or if this section is found unenforceable, disputes will be resolved exclusively in the state or federal courts located in New Castle County, Delaware, and you and Sable consent to their jurisdiction.
Consumers in the European Economic Area and the United Kingdom. This section does not apply to you. You are not required to arbitrate, you do not waive any right to take part in a class or representative action, and you may bring proceedings in the courts of the country where you live. We will bring ours there too.
Consumers elsewhere. If you live in another place whose law gives you the right to bring claims in your local courts or under your local law, nothing in this section takes that right away.
18. Governing law
If you are not a consumer in the European Economic Area or the United Kingdom, these Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules.
If you are a consumer in the European Economic Area or the United Kingdom, these Terms are governed by the laws of the country where you habitually live, and you may bring proceedings in your local courts.
Wherever you live, you keep the protections of any consumer law of your country that cannot be waived by agreement.
19. General
These Terms, together with the Privacy Policy and any program conditions shown in the app, are the entire agreement between you and Sable about the Service. If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms are written in English; if we provide a translation and it conflicts with the English version, the English version controls, to the extent the law allows.
